Wikileaks-verdachten krijgen geen inzicht in dataverzoeken

De verdachten in het Wikileaks-onderzoek, onder wie Nederlander Rop Gonggrijp, mogen niet weten welke bedrijven hun data aan de Amerikaanse justitie hebben gegeven.

De drie verdachten in een onderzoek door de Amerikaanse justitie tegen betrokkenen bij Wikileaks hebben opnieuw van de rechtbank te horen gekregen dat geheim blijft welke bedrijven hun gegevens hebben overhandigd aan de Amerikaanse overheid. Daartoe besloot de rechtbank vrijdag in hoger beroep, meldt Wired. Volgens de rechters is geheimhouding noodzakelijk om het opsporingsonderzoek in goede banen te leiden. “Openheid zal de operaties van de overheid in de weg zitten.”

De drie verdachten zijn de Nederlandse hacker en XS4All-oprichter Rop Gonggrijp, de Amerikaanse hacker en Tor-medewerker Jacob Appelbaum en de IJslandse parlementariër Birgitta Jonsdottir.

De verdachten kwamen er eerder achter dat justitie bij Twitter, Google en Sonic.net gegevens over hen had opgevraagd. De overdracht van die data probeerden ze via de rechter te voorkomen, maar dat mislukte, ook in hoger beroep. Twitter moest daardoor onder meer contactgegevens van de drie en ip-adressen overhandigen. Hoogstwaarschijnlijk heeft het Amerikaanse OM vergelijkbare data bij andere internetbedrijven gevorderd, maar waar precies blijft nu onduidelijk.

Bradley Manning wil deels schuld bekennen over lekken WikiLeaks

De Amerikaanse militair Bradley Manning heeft aangeboden gedeeltelijk schuld te bekennen. Dat zei zijn advocaat tijdens een pro-forma zitting. Het zou een eerste teken zijn dat hij toegeeft geheime diplomatieke informatie te hebben gelekt aan WikiLeaks.

Zijn advocaat David Coombs schreef in een blogpost dat dit een proces is van “uitzonderingen en “vervangingen”. Manning bekent niet alle beschuldigingen:

“Ter verduidelijking: Manning bekent geen schuld voor alle aanklachten waarvan de regering hem beschuldigt. In plaats daarvan neemt hij verantwoordelijkheid voor een deel van de strafbare feiten die hem worden verweten. De rechter zal beslissen of dit toelaatbaar is.”

Volgens Coombs is het aan de rechter om te beslissen of zijn verzoek zonder toestemming van de aanklagers kan worden ingewilligd. Maar zelfs als de rechter besluit dat Manning gedeeltelijk schuld mag bekennen, over beschuldigingen die minder ernstig zijn dan de aanklacht, dan nog kan de Amerikaanse regering Manning op alle aanklachten vervolgen.

Dat zijn er in totaal 22. Een daarvan is het helpen van de vijand – daarvoor kan hij levenslang krijgen. “De vijand” is volgens de aanklagers een afdeling van het terroristische netwerk Al Qaeda op het Arabisch Schiereiland, opgericht door Osama Bin Laden. Verder wordt hij beschuldigd van onder meer het stelen van opnamen die aan de VS toebehoren en het onrechtmatig plaatsen van die informatie op internet.

Manning erkent lekken diplomatieke informatie

Volgens blogger Kevin Gosztola, die bij de hoorzitting aanwezig was, zal Manning bekennen duizenden documenten naar WikiLeaks te hebben gelekt. De beschuldigingen van spionage, het helpen van de vijand en het toegang verschaffen aan netwerken van de overheid zou hij niet onderschrijven. De advocaat van Manning vermeldt op zijn blogpost echter geen details.

Nathan Fuller, woordvoerder van het activistische Bradley Manning Support Network zegt tegen persbureau Reuters dat het “erg prematuur” is om te concluderen dat een deal kan worden bereikt. De regering heeft nog niet gereageerd op het aanbod van Manning en voordat dat gebeurt zal de rechter zich er niet over aanspreken, zegt Fuller. Er wordt verwacht dat officieren van justitie de uitspraak op zijn minst zullen overwegen.

Zes weken durend proces begint 4 februari

Aanklagers bschuldigen Manning van het vrijgeven van honderdduizenden diplomatieke documenten, militaire rapporten en een video van een helikopteraanval in Irak waarbij twee journalisten omkwamen. WikiLeaks heeft nooit bevestigd dat Manning achter de cables zat. Er zou wel bewijs zijn dat aantoont dat Manning contact heeft gehad met WikiLeaks oprichter Julian Assange.

Manning werd op 26 mei 2010 gearresteerd in Irak. Hij werd daarna in eenzame opsluiting vastgehouden in Virginia, omdat de angst bestond dat hij zichzelf anders van het leven zou beroven. Na internationale verontwaardiging is hij in juli 2011 overgeplaatst naar een gevangenis waar hij kan communiceren met andere gedetineerden. Hij zit nu vast in Kansas. Het proces tegen hem zal zes weken duren en begint 4 februari.

Wordt Anonymous volwassen? Nieuwe acties, een nieuw boek, een documentaire. Hackersbeweging Anonymous lijkt de puberteit ontgroeid en een nieuwe levensfase in te gaan. Wat schuilt er achter de beweging van Anonymous? Doet het er toe om te weten wie het zijn? En wat is de rol van de Nederlandse tak van Anonymous?

En waarom werken ze in tegenstelling tot de Verenigde Staten hier soms wel samen met overheidsdiensten? We vragen het Anonymous zelf, aan leden die alleen anoniem voor de camera hun verhaal willen vertellen.

Niet uit angst voor represailles maar ook vanwege hun werkgevers, sommige leden werken zelfs bij de overheid, willen leden vaak niet geassocieerd worden met protestacties, Ddos-aanvallen of publicatie van gevoelige documenten. Via bekende Anonymous IRC-chatkanalen in de Verenigde Staten komen we uiteindelijk in contact met Nederlandse Anonymous-’leden’ die al sinds de tijd van de strijd van Anonymous tegen Scientology actief zijn.

Daarnaast spreken we met Danny Mekic, internetkenner en jurist, en de Amerikaanse schrijfster Parmy Olson. Zij schreef het boek ‘We Are Anonymous’ dat deze week uitkwam en waarvoor ze sprak met vrijwel alle hoofdpersonen die de afgelopen jaren een rol speelden binnen Anonymous. US calls Assange ‘enemy of state’

THE US military has designated Julian Assange and WikiLeaks as enemies of the United States – the same legal category as the al-Qaeda terrorist network and the Taliban insurgency.

Declassified US Air Force counter-intelligence documents, released under US freedom-of-information laws, reveal that military personnel who contact WikiLeaks or WikiLeaks supporters may be at risk of being charged with “communicating with the enemy”, a military crime that carries a maximum sentence of death.

The documents, some originally classified “Secret/NoForn” – not releasable to non-US nationals – record a probe by the air force’s Office of Special Investigations into a cyber systems analyst based in Britain who allegedly expressed support for WikiLeaks and attended pro-Assange demonstrations in London.

The counter-intelligence investigation focused on whether the analyst, who had a top-secret security clearance and access to the US military’s Secret Internet Protocol Router network, had disclosed classified or sensitive information to WikiLeaks supporters, described as an “anti-US and/or anti-military group”.

The suspected offence was “communicating with the enemy, 104-D”, an article in the US Uniform Code of Military Justice that prohibits military personnel from “communicating, corresponding or holding intercourse with the enemy”.

The analyst’s access to classified information was suspended. However, the investigators closed the case without laying charges. The analyst denied leaking information.

Mr Assange remains holed up in Ecuador’s embassy in London. He was granted diplomatic asylum on the grounds that if extradited to Sweden to be questioned about sexual assault allegations, he would be at risk of extradition to the US to face espionage or conspiracy charges arising from the leaking of hundreds of thousands of secret US military and diplomatic reports.

US Vice-President Joe Biden labelled Mr Assange a “high-tech terrorist” in December 2010 and US congressional leaders have called for him to be charged with espionage.

Sarah Palin and Mike Huckabee – both once involved in presidential campaigns – have both urged that Mr Assange be “hunted down”.

Mr Assange’s US attorney, Michael Ratner, said the designation of WikiLeaks as an “enemy” had serious implications for the WikiLeaks publisher if he were to be extradited to the US, including possible military detention.

US Army private Bradley Manning faces a court martial charged with aiding the enemy – identified as al-Qaeda – by transmitting information that, published by WikiLeaks, became available to the enemy.

Mr Ratner said that under US law it would most likely have been considered criminal for the US Air Force analyst to communicate classified material to journalists and publishers, but those journalists and publishers would not have been considered the enemy or prosecuted.

“However, in the FOI documents there is no allegation of any actual communication for publication that would aid an enemy of the United States such as al-Qaeda, nor are there allegations that WikiLeaks published such information,” he said.

“Almost the entire set of documents is concerned with the analyst’s communications with people close to and supporters of Julian Assange and WikiLeaks, with the worry that she would disclose classified documents to Julian Assange and WikiLeaks.

“It appears that Julian Assange and WikiLeaks are the ‘enemy’. An enemy is dealt with under the laws of war, which could include killing, capturing, detaining without trial, etc.”

The Australian government has repeatedly denied knowledge of any US intention to charge Mr Assange or seek his extradition.

However, Australian diplomatic cables released to Fairfax Media under freedom-of-information laws over the past 18 months have confirmed the continuation of an “unprecedented” US Justice Department espionage investigation targeting Mr Assange and WikiLeaks.

The Australian diplomatic reports canvassed the possibility that the US may eventually seek Mr Assange’s extradition on conspiracy or information-theft-related offences to avoid extradition problems arising from the nature of espionage as a political offence and the free-speech protections in the US constitution.

Mr Assange is scheduled this morning to speak by video link to a meeting on his asylum case on the margins of the United Nations General Assembly in New York. The meeting will be attended by Ecuadorean Foreign Minister Ricardo Patino.

In a separate FOI decision yesterday, the Department of Foreign Affairs confirmed that the release of Australian diplomatic cables about WikiLeaks and Mr Assange had been the subject of extensive consultation with the US.

Swedish rape warrant for Wikileaks’ Assange cancelled

Sweden has cancelled an arrest warrant for Wikileaks founder Julian Assange on accusations of rape and molestation.

The Swedish Prosecution Authority website said the chief prosecutor had come to the decision that Mr Assange was not suspected of rape but did not give any further explanation.

The warrant was issued late on Friday.

Wikileaks, which has been criticised for leaking Afghan war documents, had quoted Mr Assange as saying the claims were “without basis”.

That message, which appeared on Twitter and was attributed directly to Mr Assange, said the appearance of the allegations “at this moment is deeply disturbing”.

In a series of other messages posted on the Wikileaks Twitter feed, the whistle-blowing website said: “No-one here has been contacted by Swedish police”, and that it had been warned to expect “dirty tricks”.

In its “official blog” on Saturday before the warrant was cancelled, Wikileaks said it was “deeply concerned about the seriousness of these allegations. We the people behind Wikileaks think highly of Julian and and he has our full support”.

The current whereabouts of Mr Assange, a 39-year-old Australian, are unclear.

Jorge Gestoso: Julian, do you believe that this interview is being heard or spied on by the London police that is surrounding this Embassy?

Julian Assange: Just a few days ago, it came out that SS10, a covert operations group, was involved in the policing around the Embassy, and also the counter-terrorism command. Quite interesting story where there was a police officer outside and a photographer from the Press Association used his zoom lens to zoom up on the piece of paper he was holding and could read all the details about what the police were doing around here. So, yes, we assume that.

Gestoso: The UK was threatening the Ecuadorian Government through a memorandum saying that they would be ready to storm the Embassy in order to arrest you. That happened the night before the Ecuadorian Government announces that you were having their diplomatic asylum. Tell us a little bit about that night.

Assange: Since I came to the Embassy two months ago, there was a policing presence; we had two policemen outside the front door most of the time. However, leading up to that night—with a formal threat made by the United Kingdom to Ecuador, saying that they had the right to go into the Embassy and take me—the number of police increased to fifty. So it was a really quite dramatic situation. We could hear police running up and down the stairs of the interior fire escape, big police vans being pulled around here. When we put out a notification that this was happening, many of our supporters turned up, some hundred people—over a hundred people—turned up outside the front, and they were live-streaming what was happening on their phones and so on, video taping constantly what was happening.

Gestoso: The press, they are criticising you, or criticising Ecuador, it’s… According to what you read, you can read that Julian Assange is Ecuador for its personal agenda, and Ecuador is using Julian Assange for political purposes for President Correa. Are you using Ecuador, or you feel that Ecuador is using you?

Assange: I don’t feel that we have been used at all. There’s a mutuality in values. There’s a mutuality also in the groups that are negatively affecting us and are negatively affecting Ecuador. So, this is… And I suppose we can even go beyond that. Let’s go straight down to the personal: that I am a person that, it has been established, is under a political persecution by the United States and its allies. That’s a fact. And that fact was recognised… We had to put a lot of work into giving the Ecuadorian Government evidence after evidence after evidence about that fact, and they created an assessment, and they’re right. They’re right that political persecution of me and our organisation is ongoing. So that’s enough. But if we then look into the broader context, Ecuador has been right to demonstrate its values in this case in, not just giving me asylum, but also then publicly. It should give every one asylum who deserves asylum and where it has the economic capacity to do so, but in going the extra mile to defending my rights in public. Because, my rights correlate to some of the values that Ecuador would like to project. And I think it does actually believe in those values.

“Secret’’ plan to arrest Assange revealed

The diplomatic row over Julian Assange’s extradition deepened on Saturday after a police officer unwittingly revealed a secret plan to seize the WikiLeaks chief “under all circumstances’’ if he stepped out of the Ecuadorian embassy here.

The officer, posted outside the embassy, was photographed with a handwritten “brief” that said Mr. Assange was to be arrested even if he left the embassy in a vehicle that had diplomatic immunity. He is stuck in the embassy since taking refuge there two months ago to avoid extradition to Sweden over sexual assault allegations. The note marked “restricted’’ and titled, “EQ Embassy brief — summary of current position re Assange’’, says: “Action required — Assange to be arrested under all circumstances. He comes out with dip. immun, as dip. bag (right to life) in dip. Vehicle — ARRESTED.’’

An embarrassed Scotland Yard insisted that “under no circumstances will an arrest be made in breach of diplomatic immunity’’. “Our object is to arrest Mr Assange for breach of bail,’’ it said.

The document, only partially visible and mostly illegible, warns of the “possibility of distraction’’ Mr. Assange’s supporters might try to create to help him escape.

Referring to an unknown agency “SS 10’’ giving “additional support’’ in carrying out the operation, it says: “Discuss possibilities of distraction SS10 to liaise … provide additional support.”

There is also a reference to Scotland Yard’s counter-terrorism command “S020’’. Most of the document, written on a ruled office sheet, is obscured by the officer’s hand.

Mr. Assange was granted asylum by Ecuador last week but Britain says it will not allow him safe passage to leave the embassy insisting that it is under “obligation’’ to extradite him as he has exhausted all options.

Veel mensen vroegen zich wat de werkelijke reden was waarom Engeland dreigde met het binnenvallen van de Ecuadoriaanse Ambassade.

Waarom zouden ze tot zulke drastische stappen overgaan? Behalve misschien als het land een veel belangrijker reden heeft dan Julian Assange die zich daar verschanst heeft?
En die reden is er klaarblijkelijk want er zit nog een tweede persoon verborgen in deze Ambassade, eentje die voor Engeland vele malen belangrijker is dan Julian Assange.

Ze is een grote dreiging voor de politieke infrastructuur van Engeland en door haar kunnen een aantal ex- en de huidige Minister President(en) achter de tralies verdwijnen. Dit geldt ook voor een aantal belangrijke individuen uit het Britse Parlement of The House of Lords.

Wie is deze dame die ze willen? Zou het misschien de kroongetuige zijn in de Chilcot Inquiry (parlementair onderzoek naar de rol van Engeland in de oorlog met Irak). Deze getuige die nooit opgeroepen is en die zwaar belastende verklaringen zou hebben afgelegd tegen Tony Blair, Gordon Brown en David Cameron om er maar eens paar te noemen.

Deze mysterieuze dame is een vrouw die bekend staat onder de naam Andrea Davison. Ze had directe toegang tot nummer 10 Downing Street, politiek hart van Engeland, voornoemde politici en tot nog een groot gedeelte van de politieke elite die haar goed kennen.

Het schijnt dat Andrea Davison evenveel weet als de vermoorde Dr. David Kelly. Deze dreigde informatie bekend te maken die absoluut niet naar buiten mocht komen zoals zaken die betrekking hadden op de oorlog met Irak, maar ook op andere duistere zaken van de Britse overheid. Zoals te lezen valt op Zonnewind:

“Dr. David Kelly, waarvan eerst werd gedacht dat hij zelfmoord pleegde, maar waarvan we nu weten dat hij vermoord werd, leidde het project. De bommen werden echter gestolen. Dr. Kelly wist het maar zweeg, een tijdje toch, en dreigde dan om de diefstal openbaar te maken. Niet alleen de diefstal overigens, maar ook de 17,8 miljoen pond ‘onkostenvergoeding’ die de wapenhandelaars voor de gestolen waar betaalden aan enkele prominente Britse politici. Kelly werd vermoord. Men probeerde de moord geheim te houden, maar het kwam uit, en binnenkort zal een zondebok ervoor achter de tralies verdwijnen”.

Andrea Davison werd gearresteerd door de politie in Derbyshire op basis van 27 aanklachten. Ze was zo slim om niet op de rechtszitting te verschijnen waar ze bij verstek tot 2,5 jaar gevangenisstraf werd veroordeeld. In plaats daarvan vluchtte ook zij, net als Assange, naar de Ambassade van Ecuador.

Dr. David Kelly en Andrea Davison hebben en hadden veel met elkaar gemeen. Beiden waren experts op het gebied van biologische wapens en beiden waren betrokken bij wapenleveranties aan Irak en de “massavernietigingswapens” en beiden waren klokkenluider.

Andrea was veiligheidsadviseur voor de Trade en Industry Select Comittee on Arms to Iraq en getuigde ook in een eerder onderzoek naar wapenleveranties aan Irak, de Scott Inquiry. Het was dankzij haar onthullingen dat de oppositieleider destijds, Neil Kinnock, onthulde dat de toenmalige conservatieve regering in het geheim wapens verkocht aan Irak.

Andrea had in december 2009 voor de Chilcot Enquiry een dossier voorbereid en stond op het punt deze in te dienen. In januari 2010 stormden 13 politiemensen haar huis binnen. Ze namen alles wat ze konden vinden mee, inclusief haar paspoort, rijbewijs, alle sleutels van haar huis, auto’s enzovoorts. Maar, het belangrijkste wat ze meenamen was het dossier met 7.000 documenten die betrekking hadden op wapenleveranties aan Irak.

Het was Andrea zelf die verklaarde dat ze bang was om “gezelfmoord” te worden en dat ze niet in staat was om zichzelf te beschermen. Dit was ook het geval met een heel goede vriend van haar, Gareth Williams, die voor de inlichtingendienst werkte en die dood werd aangetroffen in een zogenaamd “safe house” in Pimlico, Londen op 23 augustus 2010. Gareth werd dood aangetroffen in een afgesloten sporttas in zijn bad. Een “zelfmoord” die fysiek onmogelijk was, moord dus en waarschijnlijk uitgevoerd door zijn werkgever MI5/6.

Deze Andrea zit ook in de ambassade van Ecuador en zij is de meest waarschijnlijke reden voor de dreigementen van Engeland om er met geweld binnen te vallen. Voor hen is zij vele malen gevaarlijker dan Julian Assange. Maar om haar als reden te gebruiken voor een inval zou echt een stap te ver zijn, zelfs voor de Engelse regering. Dan maar concentreren op Julian, want Engeland wil maar al te graag aan haar verplichtingen voldoen om hem uit te leveren.

Wikileaks Finds A Friend In Anonymous With #OpFreeAssange

Wikileaks and Anonymous have been close for quite some time now. Many of the recent leaks that have come out of Wikileaks were obtained by members within Anonymous. With Julian Assange under fire at the Ecuadorian embassy, Anonymous have taken it upon themselves to back him up with their usual tactics.

Computer World UK is reporting that Anonymous attacked various UK government Web sites with DDoS attacks. It’s called #OpFreeAssange and it’s a protest against the UK’s handling of the Assange situation. After being granted asylum by the government of Ecuador, the UK says that they will still arrest Assange if he steps out of the embassy.

Anonymous took down the Web sites for the Ministry of Justice, the Department for Work and Pensions, the Home Office and the Prime Minister. Like most Anonymous protests, the main goal is to draw attention to the issue. The government isn’t going to give Assange a free ride just because Anonymous hacked a couple of Web sites.

While the fight is taking place in the UK, it was started in Sweden. Anonymous is hoping to rile up the citizenry of Sweden to demand that the authorities stop their campaign against Assange. They took down the site for Primavi (it’s still down) and defaced it with a message and the YouTube video of Assange’s speech from the embassy.

As of this writing, the UK sites are all back up and functioning properly. There appears to be a countdown clock pointing to when Anonymous will resume their DDoS attacks, however, so expect the sites to go back down in about 5 hours. Like I said, it won’t do them any good as far as influencing the outcome of all of this. We’ll just have to wait and see what comes out of a meeting of South and Central American countries later this week.
